In compliance with Legislative Decree no. 196, 30 June 2003 (Privacy Consolidation Act), as amended, we hereby provide the required information regarding the processing of your personal and possibly sensitive data in our possession. This information circular does not apply to any other websites linked to from the website whose domain is owned by CANALI S.P.A single member company, which shall not be considered in any way liable for third party websites. Two types of data are generated during access to the Site: data deriving solely from user navigation and data provided voluntarily by the user for specific purposes. Data deriving from user navigation The information systems and software procedures responsible for the operation of the Site, during normal service, acquire certain data whose transmission is implicit in the use of Internet communication protocols. This information is not gathered for association with identified interested parties, but could because of its very nature make it possible to identify users through processing and association with data held by third parties. Such data processing and association activities are never performed by the data controller. The data in this category includes the IP addresses of computers used to connect to the Site, the addresses in URI (Uniform Resource Identifier) notation of the resources requested, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numeric code indicating the server reply state (successful, error, etc.) and other parameters relating to the operating system and the user’s computing environment. This data is used exclusively in anonymous form and for statistical purposes in connection with the use of the Site and its correct operation. The data may be used and retained in the event of suspected cyber crimes to the detriment of the Site, in which case CANALI S.P.A single member company reserves the right to apply to the competent authorities to determine any liability.
Data provided by users on a voluntary basisThe personal data of users who voluntarily interact with the Site and provide such data to obtain specific services (paid services, requests for commercial information, participation in a forum, sending in a resume or emails, etc.) is used for the sole purpose of performing the service requested and transmitted to third parties only in the event that this is strictly necessary to perform the service (shipment of materials, assistance, etc.). Further specific information is reported or displayed on Site pages relating to services provided on request, in such a way as to draw the attention of the interested party to the processing of their personal data. Apart from the aforementioned clarifications regarding navigation data, the provision of users’ personal data is optional but required to deliver certain services; in these cases, therefore, the failure to provide the data could compromise delivery of the service or make same impossible.
CookiesThe software applications used may contain “cookie” technology. The main function of cookies is to aid user navigation. Cookies can provide information about Site navigation and make it possible to offer several services which require information about the sequence of Site pages the user has visited. Purposes of processing for which you grant your consent if required (article 23, Legislative Decree 196/03)a) Management of data processing regarding: - data collection forms in the contact area of this internet site in order to send the information you have requested; - activities closely connected with and instrumental in the process of relationship management (e.g.: acquisition of information prior to stipulating a contract, performance of operations based on obligations deriving from contracts stipulated, etc.) and any transfers of data to foreign countries, including countries outside the E.U., within the limits established by the law (set forth below as regards communication and diffusion); - the provision of goods and services and the protection of accounts receivable deriving from same; - access control to areas protected by passwords; - site improvement and protection; - the processing of requests for information. b) Management of data regarding: - data collection forms in the newsletter area of this internet site for the purpose of receiving periodical emails; - the receipt of commercial and promotional communications from CANALI S.P.A single member company; - the organisation of fashion shows, events, promotions and similar. Users’ personal data will not be used for the purposes set forth in point b) without having first received their consent. At the time of providing their personal data, users may also accept these purposes.
Method of processing - StorageProcessing will be automatic and manual, using methods and tools designed to ensure the utmost security and confidentiality, by parties engaged specifically for this purpose in compliance with the provisions of article 31 and subsequent, Legislative Decree 196/03. The data will be retained for no longer than is strictly necessary in relation to the purposes for which the data was collected and subsequently processed.
Scope of communication and diffusionThe personal data processed will not be subject to diffusion but may be transmitted by CANALI S.P.A. single member company for the purposes set forth above to the associated and/or subsidiary companies of CANALI S.P.A. single member company, to companies in the CANALI group and to companies controlled by companies bound by contract to CANALI S.P.A. single member company or which form part of the distribution network of same (branch offices, importers, distributors, …), which may also be based in countries outside the European Union, in which case such personal data will be processed by same exclusively for the aforementioned purposes. The data may also be communicated to foreign countries in the European Union in compliance with and within the limits of article 42, Legislative Decree no. 196/2003. The personal data may also be transferred to foreign countries outside the EU within the limits provided by article 44, letter b), Legislative Decree no. 196/2003. The data may only be communicated to third parties in the following categories: - parties which supply services to manage the information system and telecommunication networks (including email) used by CANALI S.P.A. single member company; - parties, including third parties, which manage the archiving of paper and/or digital documentation; - companies bound by contract to CANALI S.P.A. single member company; - public entities and administrations in relation to verifications and controls regarding tax and civil law obligations. Parties in the aforementioned categories perform the function of Data Processor or operate in full independence as individual Data Controllers. The list of any data processors is constantly updated and available for consultation at the head office of CANALI S.P.A. single member company - Via Lombardia, 17/19 - 20845 Sovico (MB). Any further communication or diffusion will require your express prior consent. The storage and transmission of personal data over the Internet is protected by commonly used and up-to-date equipment and technology.
Nature of data provision and denial of consentData provision is optional but necessary in order to be contacted by CANALI S.P.A. single member company. The denial of consent to process data in relation to point b) makes it impossible to use your data for the purposes set forth in point b). You may nevertheless receive the information requested in the contact area of the website. You may exercise your rights as set forth in articles 7, 8, 9 and 10, Legislative Decree no. 196, 30 June 2003, by contacting the Data Controller (or processor, if appointed).
Article 7. Right of access to personal data and other rights1. Interested parties have the right to receive confirmation of whether or not personal data is held regarding them, even if such data has not yet been registered, and the transmission of same in intelligible form. 2. Interest parties have the right to obtain information regarding: a) the origin of the personal data; b) the purposes and methods of processing; c) the logic applied in the event of processing performed with the aid of electronic tools; d) the identity of the data controller, the data processor and the designated representative pursuant to article 5, section 2; e) parties and categories of parties to whom the personal data may be communicated or who may gain knowledge of same in their capacity as designated representative in the territory of the State, as data processors or as persons in charge of processing. 3. Interested parties have the right to obtain: a) the updating, correction and addition of data if of interest; b) the cancellation, anonymisation or blocking of data processed in breach of the law, including data which does not have to be retained in relation to the purposes for which the data was collected or subsequently processed; c) certification that the operations set forth under letters a) and b), including their content, have been notified to the parties to whom the data has been communicated or diffused, with the exception of the case in which such obligation is impossible to discharge or requires an effort that is manifestly disproportionate to the right protected. 4. Interested parties have the right to object entirely or in part: a) to the processing of their personal data, for legitimate reasons, even though such data is pertinent to the purpose of collection; b) to the processing of personal data regarding same for the purpose of sending advertising or direct marketing material, or for the purpose of market research and commercial communication.
